• Final pricing will be determined in the formal contract agreement.

Project Agreements

The formal contract supersedes any prior verbal or written communications.

Payment Terms

• Payment is due according to the schedule specified in your contract.
• Late payments may be subject to interest charges as permitted by Arizona law.
• We accept various payment methods including cash, check, credit card, and financing through approved lenders.

Warranties

We stand behind the quality of our work. Warranty details include:

• Our workmanship warranty covers structural integrity and construction quality
• Equipment warranties are provided by the respective manufacturers

• Warranties do not cover damage from improper use, lack of maintenance, or acts of nature

Project Timeline

While we strive to complete projects within the estimated timeframe:

Property Access and Damage

• You grant us access to your property during normal business hours to complete the project.

• We carry liability insurance to cover damages that may occur during the course of our work.
• You are responsible for securing pets and personal belongings during construction.

Permits and Regulations

We will obtain necessary permits for pool construction as required by local authorities. You are responsible for ensuring compliance with any HOA requirements or covenants affecting your property.

Limitation of Liability

To the fullest extent permitted by law, Desert Soul Landesign shall not be liable for any indirect, incidental, special, or consequential damages arising from our services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.

Intellectual Property

All designs, plans, and materials created by Desert Soul Landesign remain our intellectual property until full payment is received. You may not reproduce, distribute, or use our designs for other projects without our written permission.

Dispute Resolution

Any disputes arising from these Terms of Service or our services shall be resolved through:

• Good faith negotiation between the parties
• Mediation, if negotiation is unsuccessful
• Binding arbitration in accordance with Arizona law

These terms shall be governed by the laws of the State of Arizona.

Photography and Marketing

We may photograph completed projects for marketing purposes. If you prefer not to have your project featured, please notify us in writing.
